Orvio Terms of Use

Last updated: September 26, 2026

This English version is provided for convenience. If it differs from the Spanish version, the Spanish version prevails.

These terms are the agreement between you and Orvio (“Orvio”, “we”, “us”), a pilot project whose operating company is being incorporated, for using orvio.do. As soon as the company is incorporated, we will identify it here by its legal name, RNC (Dominican taxpayer number) and registered address, and notify you. Please read them together with our Privacy Policy.

You can browse listings without an account. To book or offer a service you need one, and before you use it you must expressly accept these terms by ticking the box that says so. We keep the version you accepted and the date. If you do not agree, do not create an account, or delete it if you already have (Privacy Policy, section 10).

Orvio is a pilot: read this first

  • Orvio is a pilot: an early version of the product. It is not yet a fully operating commercial marketplace, and its features may change.
  • Payments inside Orvio are simulated. Orvio does not ask for card details, does not charge by card or payment link, does not receive or hold money, and does not issue invoices. The deposit and link payments you see are system records used to test how a booking works: they move no real money.
  • Bank transfers of the balance are the exception. If you choose to pay the balance by bank transfer, that transfer is real money and goes straight to the operator's account. It includes Orvio's commission and the booking's ITBIS (sections 3 and 6). Orvio does not receive it, does not hold it and cannot refund it.
  • Listing photos are illustrative. During the pilot, operators cannot upload their own photos: they choose a reference image from Orvio. The photo does not show the cart, boat or vehicle you will get. If you want to know what it looks like, ask the operator in the chat.
  • Trust signals are declared by the operator. Formality, insurance, licence and tax-receipt status are shown as the operator declared them and may be out of date (section 1).
  • Before real payments are switched on inside Orvio, we will publish the charging, cancellation and refund rules that will apply, and we will ask you to accept the updated terms.

1. What Orvio is

Orvio is a platform that connects travelers and residents (“travelers”) with independent local operators (“operators”) of golf carts, boats and day charters, and shuttles in the Casa de Campo – La Romana – Bayahibe corridor. During the pilot, not every category is available; the site shows the ones that are.

What Orvio does. Orvio provides you with an intermediation and booking service, for which it charges the commission shown in the price breakdown. It runs the platform; reviews the details each operator declares (identity, formality, licence and insurance) before listing its fleet; shows you an itemized price before you send a request; keeps the record of each booking and its chat; and handles complaints (section 10). Orvio does not own or operate carts, boats or vehicles.

What it means that Orvio reviews an operator. We review the details the operator gives us when applying to operate on Orvio, as of the date of that review. After approval, the operator can change those details, and the change is not reviewed again. The trust signals you see on a listing (formality, insurance, INTRANT licence and tax receipt) are the ones the operator declared and may be out of date; for example, insurance status does not change on its own when the policy expires. The review is not a guarantee of the service. If insurance or the licence matter to you, ask the operator to show them to you before booking.

Who provides the service you book. The service (the cart rental, the boat trip or the shuttle) is provided by the operator. The operator:

  • sets its own prices;
  • decides whether to accept or decline each request;
  • sets the deposit percentage and what happens if the balance is late;
  • delivers the cart, boat or shuttle, and is responsible for its condition, its safety, and for having the permits, licences, insurance and staff the law requires;
  • issues the comprobante fiscal (tax receipt) for its service, where applicable.

Your rights as a consumer. Where Dominican Law No. 358-05 on the Protection of Consumer or User Rights makes Orvio liable together with the operator, Orvio will answer to you and may then claim against the operator (section 9, Indemnity). Nothing in these terms limits your rights under that law or under any other rules that cannot be waived.

2. Your account

  • You must be at least 18 years old and legally able to enter into contracts. You confirm that you are by ticking the acceptance box, before you use your account.
  • Give accurate information. You cannot edit your name or email in the platform yet: if they change, write to info@orvio.do and we will update them.
  • Your account is personal. Keep your password safe and do not share it: you are responsible for what is done with your account, unless it is due to a failure on Orvio's side. If you think someone has accessed it without permission, write to info@orvio.do right away.
  • If you sign in with Google, Google's terms for its sign-in service also apply.
  • You agree that your agreements with Orvio and with operators may be formed electronically. They are as valid as a paper document (Law No. 126-02 on Electronic Commerce, arts. 4 and 13).

3. Prices

  • Each operator sets its price. During the pilot, prices are shown in US dollars (USD).
  • The price on a listing card is the operator's price, without Orvio's commission or ITBIS. Before you send a request, you see the full breakdown: the operator's price, Orvio's commission (currently 15%, a provisional rate), ITBIS (18% Dominican VAT, calculated on the price plus the commission) and the total.
  • You also see the payment plan: the deposit, the balance, when the balance is due and what happens if it is late. The time to pay the deposit starts when the operator accepts your request (section 4).
  • The deposit is a percentage of the operator's price. Orvio's commission and ITBIS are included in the balance. So if you pay the balance by transfer, you also transfer Orvio's commission and the ITBIS to the operator (section 6).
  • If the operator declares that it can issue a comprobante fiscal, its listing says so.

4. How a booking works

  1. Request. You choose dates and write a message to the operator. A request is not a confirmed booking and nothing is charged. If the operator does not respond, the request stays pending at no cost to you; if you want to withdraw it, write to us.
  2. Chat. You can talk to the operator inside Orvio before and after they respond.
  3. Operator's answer. The operator accepts or declines your request. When accepting, the operator may adjust the deposit percentage for your booking; you will see the amount before you pay. If you do not agree, do not pay: the request will expire at no cost to you.
  4. Deposit. If the operator accepts, you have a set time to pay the deposit (currently 24 hours; in this pilot, that payment is simulated). Once you pay it, the booking is confirmed. If you do not pay in time, the request expires and the dates are released.
  5. Balance. The balance is due at 12:00 a.m. on the day before the service, Dominican Republic time; that is, at the start of that day. Example: if your service is on Saturday, the balance is due at 12:00 a.m. on Friday, right as Thursday ends. For last-minute bookings you get at least one hour after paying the deposit. The exact date and time are shown on your booking. You can pay the balance by payment link (simulated in this pilot) or by bank transfer directly to the operator (section 6).
  6. If the balance is late, the operator's policy that you saw before booking applies:
    • Cancellation: the booking is cancelled and the operator keeps the deposit; or
    • Late fee: the booking continues and a one-time surcharge, equal to the percentage of the balance set by the operator, is added.

    In this pilot the deposit is simulated, so losing it costs you no real money. The late fee is real money if you then pay the balance by transfer.

    A transfer you report before the deadline is not considered late while the operator reviews it. But if the operator rejects it after the deadline has passed, the late-payment policy applies within minutes, with no extra time to pay again. Transfer early and check the details carefully before sending.

  7. After the service, you can leave a review (section 7).

Some of these rules are applied automatically by the system; for example, an accepted request expiring or the late-payment policy.

5. Cancellations

  • Cooling-off period. You can cancel without penalty within 3 business days after your booking is confirmed, as long as the service has not started. If you have already transferred money to the operator, the operator must refund it in full.
  • After that period. In this pilot, Orvio charges no cancellation fees, and the simulated deposit is not real money. Anything you have actually paid the operator (for example, the balance by transfer) is refunded under the cancellation policy the operator shows on its listing before you send your request. If the listing shows none, the operator must refund everything you transferred.
  • If the operator cancels, it must refund everything you paid it.
  • How to cancel. There is no cancel button in this pilot yet. If you need to cancel, tell the operator in the booking chat and write to info@orvio.do with your booking code. Our team records the cancellation by hand.
  • The “refunded” label. When a booking is cancelled, the system may label it “refunded”. That label refers only to the simulated payments: if you paid the balance by transfer, it does not mean the operator has returned that money.
  • Money paid directly to the operator. The operator refunds that money, under the rules in this section and the law. Orvio can help you resolve it (section 10), but it cannot refund money it never received.
  • Operators: if you need to cancel a booking, write to info@orvio.do so we can record it, and let the traveler know in the chat. Only cancel for good reason, and refund what the traveler paid you. Repeated or unjustified cancellations may lead to your account being suspended.

6. Paying the operator directly (bank transfer)

  • When you owe the balance on a confirmed booking, Orvio shows you the bank details the operator has registered.
  • You make the transfer yourself, from your bank, to the operator's account. It is a real payment between you and the operator; Orvio does not receive or hold it.
  • What it includes. You transfer the full balance shown on the booking, plus the late fee if one was applied. That balance includes the rest of the operator's price, Orvio's commission and the ITBIS for the whole booking. All of it reaches the operator's account; Orvio and the operator settle Orvio's share afterwards, and that does not change what you pay.
  • Then upload the receipt or reference to the booking. The operator confirms or rejects the payment, and you will see their answer on the booking.
  • Before transferring, check that the account holder matches the operator. If something does not look right, do not transfer and write to us.
  • Never send card details in the chat.

7. Reviews

  • Once a booking has ended, you can rate the operator from 1 to 5 stars and leave a comment. One review is allowed per booking.
  • Reviews are public and show your first name, the service and the date.
  • Once published, you cannot edit your review in the platform. If you want it removed, write to us.
  • Your review must reflect your real experience. Do not post insults, threats, anyone's personal data, advertising or illegal content.
  • We may remove reviews that break these rules or the law. Today we do this by hand, on request or when we spot it. We do not remove a review just because it is negative.
  • Operators cannot edit or delete reviews, and must not offer benefits or pressure anyone in exchange for a review.

8. Rules of use

You may not:

  • give false information or impersonate someone else;
  • use Orvio for illegal or fraudulent purposes;
  • harass, threaten or discriminate against other users;
  • post content that is not yours or that infringes other people's rights;
  • post or send photos or data that identify a minor without the written permission of their parent or guardian;
  • try to access other people's accounts or data, interfere with the platform, or scrape data automatically;
  • use other users' data for anything other than the booking; for example, to send them advertising.

Keep the conversation inside Orvio. If you pay the operator anything outside the platform (for example, in cash), say so in the booking chat: that way there is a record if something goes wrong.

9. If you are an operator

In addition to everything above:

  • Sign-up and review. To list, you must complete your profile and vetting data and accept these terms. Orvio reviews them and may approve, reject or suspend an operator account. Orvio's review does not relieve you of your legal obligations.
  • Your representations. You state that the information you give us is true, and you agree to keep it up to date, especially your insurance expiry date and your licence status. That information is shown on your listings as declared by you: if it stops being true, correct it right away.
  • Compliance. You are responsible for complying with the rules that apply to your business: traffic and transport, navigation, tourism, tax obligations before the DGII, employment and consumer protection.
  • Price and conditions. You set your price (in USD during the pilot), your deposit (between 10% and 100%) and your late-payment policy. You must honor the price and conditions the traveler saw when sending the request and, where applicable, the deposit you set when accepting it.
  • Listing images. During the pilot you cannot upload photos: you choose an illustrative image from Orvio. Do not present it as your own cart, boat or vehicle, and answer truthfully when a traveler asks what it looks like.
  • Requests. You decide on each request; nothing is accepted automatically.
  • Cancellations and refunds. Honor the cooling-off period and the refund rules in section 5, and refund what is due without delay.
  • The service. You must provide it as you describe it, with equipment that is in good condition and safe, and with the staff and documents the law requires.
  • Bank details. You are responsible for their accuracy. They are shown only to a traveler who owes you a balance and to authorized Orvio staff. Confirm or reject transfers honestly and promptly: if you reject one after the deadline, the late-payment policy applies right away.
  • Public trust signals. You agree that Orvio may show on your listings, as declared by you, your formality status, insurance status, INTRANT licence status and whether you issue a comprobante fiscal. We never publish your cédula, RNC, licence or policy numbers, or your bank details.
  • Blocked dates. Do not write personal data in the note of an availability block: because of how the platform works today, that note can be looked up publicly.
  • Travelers' data. Use the data you receive (name, email and messages) only to handle the booking. Do not use it for advertising without the traveler's consent, keep it safe, and delete it when you no longer need it. If we tell you a traveler has corrected or deleted their data, do the same with your copy. You are responsible for how you use it.
  • Orvio's commission and transfer payments. Orvio's commission is shown on each booking (currently 15%, provisional, plus ITBIS). If the traveler pays you the balance by transfer, you also receive Orvio's commission and the ITBIS for the whole booking, which are included in that balance. That part is not yours: you receive it on Orvio's behalf and must hand it over when we ask, in the way we tell you in writing. Orvio records what it owes you and what you owe it in its settlement ledger. While payments inside the platform are simulated, Orvio does not pay you any money; before it starts, we will tell you in writing the settlement, invoicing and tax-withholding terms.
  • Indemnity. You will cover the claims, damages and reasonable costs Orvio incurs because of your service, your breach of these terms or the law, or false information you gave us. This includes anything Orvio has to pay a traveler because of a problem with your service.
  • Closing your account. Write to info@orvio.do. Your fleet must first be taken down and any pending bookings and payments resolved (Privacy Policy, section 10).

10. Complaints

  • If something goes wrong with the service, talk to the operator first in the booking chat.
  • If that does not resolve it, write to info@orvio.do with your booking code. We will confirm we received your complaint within 2 business days and give you an answer within 10 business days. We will review the booking history and chat and help you find a solution with the operator.
  • If you are a consumer, you can also go to Pro Consumidor (the Dominican consumer protection agency) at any time.

11. Content and intellectual property

  • The Orvio brand, the site design, the illustrative images and the software belong to Orvio or its licensors. You may not copy or use them without written permission.
  • The content you post (listing texts, messages and reviews) remains yours. You give us a free, non-exclusive permission to host, reproduce and display it on Orvio for as long as needed to run the platform. You confirm that you have the right to post it.

12. Liability

  • Orvio is responsible for its own obligations: running the platform diligently, carrying out the operator review described in section 1, the accuracy of the information Orvio itself prepares (for example, the price breakdown), and protecting your data as set out in the Privacy Policy.
  • Listing information and trust signals are declared by the operator, who is responsible for their accuracy.
  • The operator is responsible to the traveler for the service it provides. Where Law 358-05 also makes Orvio liable, Orvio will answer and may claim against the operator.
  • Orvio does not guarantee that the platform will run without interruptions or errors, especially during the pilot.
  • Toward operators, and to the extent the law allows, Orvio's liability is limited to direct damages, up to the amount of commissions the operator paid Orvio in the 12 months before the event, except in cases of fraud or gross negligence.
  • Nothing in this section excludes or limits any liability that the law does not allow to be excluded, including liability toward consumers under Law 358-05.

13. Suspension and termination

  • You can stop using Orvio at any time and ask us to close your account (Privacy Policy, section 10).
  • We may suspend or close an account if it breaches these terms, if there are signs of fraud or risk to other users, or if an authority orders it. We will tell you and give you the reason, unless the law or other people's safety prevents it.
  • The pilot may change or end. If it ends, we will give you reasonable notice. Bookings that are already confirmed remain an agreement between the traveler and the operator.

14. Changes to these terms

  • We will tell you about every change before it takes effect, with a visible notice on Orvio stating the date. If a change is significant, we will also notify you by email at least 15 days in advance and ask you to accept the new version.
  • Changes do not affect bookings that are already confirmed.
  • If you do not agree with a change, you can stop using Orvio and ask us to close your account.

15. Governing law, courts and language

  • These terms are governed by the laws of the Dominican Republic.
  • Any dispute will be heard by the competent courts of the Dominican Republic. If you are a consumer, you keep your right to go to Pro Consumidor. Nothing requires you to go to arbitration.
  • If any clause is found invalid, the rest of these terms remain in force.
  • If this English version differs from the Spanish version, the Spanish version prevails.
